Mr S was facing a driving ban for totting up following a speeding offence. He already had 10 points on his driving licence.

Represented by Carl Millar, an exceptional hardship submission was made on behalf of Mr S detailing the ramifications were he to lose his driving licence. The court heard how Mr S needed his driving licence for his employment and would lose his job should he not be able to drive. Mr S worked as a contracts manager and needed to drive all over the country to fulfil his job. It became clear that his family relied upon his sole income and were it to cease his house would face repossession and exceptional hardship would be suffered by his wife and three children.
After due deliberation, the court found in favour of exceptional hardship and Mr S was not disqualified from driving.
